1. Conclusion of the contract

 

 

 

With your order you submit a binding offer to us to make a contract. Through sending you a Proforma Invoice by e-mail or sending you the best goods possible. A purchase contract is only conlcluded when our order confirmation is sent to you by e-mail or delivery of material.

 

 

 

When ordering from our online shop, the ordering process consists of four steps. The first step is selecting your desired goods. In the second step you can check your cart and choose the payment method. In the third step, you enter your customer data including the billing address and an alternative shipping address if required. In the last step, you have the option of reviewing all details (e.g. name, address, form of payment, ordered items) again and making corrections before sending your order by clicking on ‘Send order’.

 

 

 

2. Storage of the contract text

 

 

 

We save the contract text of your order. You can print it before sending the order out to us through clicking on “Print” on the final step of your order. We will also send you a order confirmation with all order detail and our general terms and conditions to the provided email address.

 

 

 

3. Retention

 

 

 

The delivered goods remain our property until all claims have been paid in full.

 

 

 

4. Prices, shipping costs, return shipping costs if canceled

 

 

 

All prices include VAT. If you make use of an existing right of cancellation, you have to bear the regular costs of the return if the delivered goods correspond to the ordered goods.

 

 

 

With a dealers login, prices may be shown excluding VAT.

 

 

 

 

 

 

 

 

 

5. Delivery conditions

 

 

 

Unless otherwise stated in the offer, we will ship the goods within 2-3 working days after receipt of payment. In the event of delivery on account or payment by direct debit, we will ship the goods, unless otherwise stated in the offer, within 2-3 working days after delivery of the order confirmation. 
 
6. Terms of payment
 
Payments can be made in the following ways by advance transfer, PayPal, after agreement upon receipt of Invoice, or SEPA mandate. We reserve the right to exclude certain payment methods. If the payment method prepayment is chosen, we will give you our bank details in the order confirmation. The invoice amount is to be transferred onto our account within 10 days. You can only exercise a right of retention if the claims result from the same contractual relationship.  

 

 

 

 

 

7. Warranty

 

 

 

The warranty is based on the statutory provisions. As far as used goods are the subject of the purchase contract and the buyer is not a consumer, the warranty period for the purchase of used items is one year.

 

 

 

8. Data protection

 

 

 

When initiating, concluding, processing and reversing a purchase contract, we collect, save and process data in accordance with the statutory provisions.

 

 

 

When you visit our website, the IP address of your PC used at the time, the date and time, the browser type and the operating system of your PC as well as the pages you are viewing will be logged. However, we are not able to draw any conclusions about personal data, nor are we intending to. 

 

 

 

The personal data that you give e.g. B. when ordering or by email (e.g. your name and contact details) will only be used for correspondence with you and only for the purpose for which you provided us with the data. We only pass on your data to the shipping company commissioned with the delivery in case it is necessary for the delivery of the goods. We also pass on your payment details to the bank responsible for your payment to process the payments.

 

 

 

We assure that we will not pass on your personal data to third parties otherwise, unless we are legally obliged to do so, or you have given your prior consent. In case a third party is require to fulfil your request, the data will be processed as per the Federal Data Protection Act.

 

 

 

Duration of storage

 

 

 

Personal data that has been communicated to us via our website will only be stored until the purpose for which they were entrusted to us is fulfilled. In this case, the commercial and tax law retention periods must be fulfilled, the duration of the storage of certain data can be up to 10 years.

 

 

 

Use of cookies

 

 

 

Our products are offered with the use of cookies. The prerequisite is that you have activated cookies in your browser settings. A randomly generated session code and possibly your customer ID are stored in the cookies. This makes recognizing you as a registered customer possible.

If you no longer consent to the storage of your personal data or if it has become incorrect, we will arrange for your data to be deleted, corrected or blocked in accordance with the relevant instructions. 9 Applicable law

10 Complaint procedure for consumers

 

 

 

In accordance with Article 14(1) of EU Regulation No.524/2013 on online consumer dispute resolution, the European Commission provides an online dispute resolution platform (OS platform).

We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board and are not prepared in principle.

 

 

 

11. Characteristics of the material

 

 

 

Natural stone is an absolutely timeless, natural product that has developed within millions of years. Differences in coloring and patterns may therefore occur. However, we strive to provide you with the most consistent product possible, which is very similar in colour and structure. For your order, please contact us to obtain a colour scheme that is as homogeneous as possible. The available colours and decors can be found in our current catalogue or sample sets.

 

 

 

The development of cavities, natural fractures or bursts are to be borne by the customer. Since Slate-Lite is a natural stone and we cannot influence the extraction and the individual slate layers, the risk lies with the customer!

 

 

 

12. Return or withdrawal from the order

 

 

 

When returning ordered goods without material defects, 25% of the sales value will be charged as handling fees.

 

 

 

The goods must be undamaged, i.e. in the same condition as they left our warehouse.

 

 

 

This will be checked upon arrival in our warehouse. Any damage that occur during return shipment are documented with photos and sent to the customer.

 

 

 

In the event of breakage, the material is credited minus 50% of the purchase price. For other defects, such as grease stains (finger greases), the material must be cleaned, resulting in 30% of the acquisition costs (per plate). The customer must ensure that he returns the goods to us in a safe and proper packaging.

 

 

 

Residual items, special formats and coated goods are excluded from exchange!

 

 

 

Inspection of the ordered goods by the customer:

 

 

 

The customer must check the goods at the time of acceptance of the package and check whether the shipping service provider has delivered the goods to the customer in perfect condition.

 

 

 

In the event of obvious damage, the customer shall not accept the goods and return them to the shipping service provider directly.

 

 

 

For all orders, care must be taken to ensure that the goods are acclimatized before unpacking (unrolling) in order to avoid breakage.

 

 

 

We recommend shipping large sizes flat in the colder months of the year (October – Easter) and in colder climates to avoid breakage due to rolling the sheets. Shipping rolled with UPS is still possible at your own risk.

 

 

 

We would like to point out that you receive all our invoices electronically as PDF by e-mail and that you must keep them in the same form in accordance with the legal requirements applicable to you. Separate paper shipping is not carried out.
